§ 1
GENERAL PROVISIONS
The store www.art-picture.eu operates under the rules specified in these Regulations.
The Regulations define the terms of concluding and terminating Product Sales Agreements and the complaint procedure, as well as the types and scope of services provided electronically by the Store www.art-picture.eu, the rules for providing these services, and the terms of concluding and terminating contracts for the provision of electronic services.
Each Service Recipient, upon taking actions aimed at using the Electronic Services of the Store www.art-picture.eu, is obliged to comply with the provisions of these Regulations.
In matters not regulated by these Regulations, the provisions of the following acts shall apply:
- the Act on Providing Services by Electronic Means of July 18, 2002,
- the Consumer Rights Act of May 30, 2014,
- the Act on Out-of-Court Consumer Dispute Resolution of September 23, 2016,
- the Civil Code Act of April 23, 1964, and other applicable provisions of Polish law.
§ 2
DEFINITIONS
- ORDER FORM – a form available on the website www.art-picture.eu enabling the placement of an Order.
- CLIENT – a Service Recipient who intends to conclude or has concluded a Product Sales Agreement with the Seller.
- CONSUMER – a natural person who performs a legal act with an entrepreneur that is not directly related to their business or professional activity.
- ENTREPRENEUR – a natural person, legal person, or organizational unit without legal personality, granted legal capacity by law, conducting business or professional activity on their own behalf.
- PRODUCT – a movable item available in the Store, which is the subject of the Sales Agreement between the Client and the Seller.
- REGULATIONS – these Online Store Regulations.
- STORE – the Online Store operated by the Service Provider at www.art-picture.eu.
- SALES AGREEMENT – a sales contract for the Product concluded between the Client and the Seller via the Store.
- ORDER – a declaration of will by the Client constituting an offer to conclude a Product Sales Agreement with the Seller.
- PRICE – the value expressed in monetary units that the Client is obliged to pay the Seller for the Product.
§ 3
PRODUCT INFORMATION AND ORDERING
The www.art-picture.eu store sells Products via the Internet.
Products offered in the Store are new, compliant with the contract, and legally placed on the market.
Information presented on the Store’s website does not constitute an offer within the meaning of the law. By placing an Order, the Client makes an offer to purchase a specific Product under the terms stated in its description.
Product prices displayed on the Store’s website are in Euros and include all components. Delivery costs are not included.
Orders can be placed via the website using the Order Form (www.art-picture.eu) – 24/7, year-round.
Placing an Order in the Store requires the Client to read and accept the Regulations during the ordering process.
§ 4
CONCLUSION OF THE SALES AGREEMENT
To conclude a Sales Agreement, the Client must first place an Order in accordance with § 3 points 5 and 6.
Upon placing the Order, the Seller promptly confirms its receipt.
Confirmation of Order receipt binds the Client to their Order. It is provided via email.
The confirmation includes:
- confirmation of all significant Order details,
- a withdrawal form,
- these Regulations, including instructions on the right to withdraw from the contract.
The Sales Agreement is concluded once the Client receives the above confirmation email.
Each Sales Agreement is confirmed with a proof of purchase included with the Product.
§ 5
PAYMENT METHODS
The Seller offers the following payment methods:
- traditional bank transfer to the Seller’s account,
- electronic payment systems.
For traditional transfers, payment should be made to:
IBAN: LT36 3250 0327 5338 8312, BIC/SWIFT: REVOLT21.
In the transfer title, enter “Order no. …”.
For electronic payments, the Client must pay before the Order is processed. Payments can be made via credit card or instant transfer from selected banks.
The Client must pay the Sales Agreement Price within 1 business day of its conclusion, unless otherwise stated.
Products will be shipped only after payment is received.
§ 6
DELIVERY COSTS, TIME, AND METHODS
Delivery costs, borne by the Client, are calculated during the ordering process.
Delivery time consists of:
- up to 14 business days for order preparation,
- up to 14 business days for courier delivery (weekdays only).
Products purchased in the Store are shipped worldwide via courier services.
§ 7
PRODUCT COMPLAINTS
Non-conformity of Product with the contract:
- The Seller’s liability toward Consumers for non-conformity is regulated by the Consumer Rights Act of May 30, 2014.
- The Seller’s liability toward Entrepreneurs is regulated by the Civil Code.
- The Seller is liable to the Consumer for any non-conformity existing at the time of delivery and revealed within 1 year, unless a longer shelf-life was indicated.
- Complaints can be submitted by email to: office@art-picture.eu
The email should include as much detail as possible: type and date of the defect, and contact details.
The Seller will respond within 14 days.
If no response is given to a Consumer’s complaint within 14 days, the complaint is considered accepted.
For justified complaints, the Seller will: - cover costs of repair or replacement and re-delivery,
- reduce the Product price proportionally and refund the difference within 14 days,
- in case of withdrawal by the Consumer – refund the Product price within 14 days of receiving the returned item or proof of return.
The Consumer bears the cost of return in case of withdrawal.
Responses to complaints will be sent on paper or another durable medium (e.g. email or SMS).
§ 8
RIGHT OF WITHDRAWAL
The Consumer may withdraw from the contract within 14 days without giving a reason.
Upon withdrawal, the Sales Agreement is void, and the Consumer must return the Product to the Seller or a designated person within 14 days.
Returns should be sent to the address on the shipping label.
The Consumer is liable for reduced Product value due to use beyond what is necessary to establish its nature, characteristics, and functioning.
The Seller will refund the Product price and delivery costs using the same payment method, unless the Consumer agrees otherwise, at no extra cost.
The Consumer bears only the cost of return shipping.
The 14-day withdrawal period starts from the day the Consumer or third party (excluding the carrier) takes possession of the Product.
The right of withdrawal does not apply to non-prefabricated items made to the Consumer’s specification or customized for personal needs.
Both Seller and Client may withdraw from the contract if the other party fails to perform its obligations within a strictly defined time.
§ 9
TYPE AND SCOPE OF ELECTRONIC SERVICES
The Seller enables the placement of Orders via the Store.
These services are provided according to these Regulations.
The Seller may include advertising content on the Store’s website, which is an integral part of the Store.
§ 10
TERMS OF ELECTRONIC SERVICES
- The service defined in §9.1 is free of charge.
- The contract for using the Order placement service is concluded for a definite period and ends upon Order submission or abandoning the process.
Technical requirements: - Internet-enabled computer or mobile device,
- access to email,
- internet browser,
- enabled Cookies and JavaScript.
The Service Recipient must use the Store lawfully and ethically, respecting third-party rights and intellectual property.
Data provided must be truthful.
Unlawful content is prohibited.
§ 11
COMPLAINTS CONCERNING ELECTRONIC SERVICES
Electronic service complaints may be submitted via email to: office@art-picture.eu
The email should include: type and date of the issue, and contact details.
The Seller will review the complaint within 14 days.
Responses will be sent to the email address provided or another contact method chosen by the Client.
§ 12
FINAL PROVISIONS
Contracts concluded via the Store are subject to Polish law.
If any part of these Regulations is found to be contrary to applicable law, the relevant legal provision shall apply in its place.
